ThunderQuest Terms of Use

Introduction; Acceptance of Terms

These Terms and Conditions of Use ("Terms of Use") govern your access to and use of the ThunderQuest website at https://thunderquest.vercel.app and the ThunderQuest Discord bot (collectively, the "Services"), which are operated by Agentic Engineer LLC and its affiliates ("Agentic Engineer," "we," "us," or "our"). By using any part of the Services, you ("you," "user," or "player") agree to be bound by these Terms of Use in full.

Please carefully read and understand these Terms of Use before accessing or using the Services. If you do not fully agree with any part of these Terms of Use, please do not use the Services. Continued use constitutes your consent to be bound by these Terms of Use.

Service Description

ThunderQuest is an elemental idle RPG game accessible through Discord and an accompanying website. The Services allow you to:

  • Create and manage a game account linked to your Discord identity
  • Collect heroes, progress through story content, and manage in-game resources
  • View your game profile and statistics on the website
  • Interact with game systems through Discord bot commands

Disclaimer of Warranties; Service Availability

The Services are provided "as is" and "as available," without any warranties of any kind, express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or free of defects. Access may be temporarily or permanently interrupted due to maintenance, technical issues, or other factors beyond our control. Agentic Engineer reserves the right to modify or discontinue any aspect of the Services at any time without notice.

Game progress, virtual items, and in-game resources have no monetary value and may be modified, reset, or removed at our discretion.

Account and Access

To use the Services, you must have a Discord account. By using the ThunderQuest Discord bot, you authorize us to access your Discord user ID and username to identify your game account. You are responsible for maintaining the security of your Discord account.

You may not:

  • Share, sell, or transfer your game account
  • Use automated tools, bots, or scripts to interact with the Services (except the official ThunderQuest bot)
  • Exploit bugs or glitches for unfair advantage
  • Harass, abuse, or harm other players

Termination

Either you or Agentic Engineer may terminate your access to the Services at any time, for any reason, without prior notice. Upon termination, your access to game data may be lost, and we will not be liable for any such loss.

We reserve the right to suspend or terminate accounts that violate these Terms of Use or engage in behavior we deem harmful to the community or Services.

Data Collection and Privacy

By using the Services, you consent to the data collection and processing described in our Privacy Policy, available at https://thunderquest.vercel.app/privacy. We collect Discord user IDs, usernames, and game progress data to provide the Services.

Intellectual Property

The Services, including all content, artwork, characters, game mechanics, and code, are protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, revocable license to use the Services for personal, non-commercial entertainment purposes.

You may not:

  • Copy, modify, or distribute any part of the Services
  • Remove or alter any copyright or trademark notices
  • Use our intellectual property for commercial purposes
  • Create derivative works based on our content

Third-Party Services

The Services integrate with Discord and may use other third-party services (Clerk, Convex). Your use of these integrations is subject to their respective terms of service and privacy policies, which you are responsible for reviewing.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGENTIC ENGINEER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS ($100).

The Services are provided for entertainment purposes. We are not responsible for:

  • Loss of game progress or virtual items
  • Service interruptions or downtime
  • Actions of other players
  • Technical issues with Discord or other third-party services

Indemnification

You agree to indemnify and hold harmless Agentic Engineer and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services or violation of these Terms of Use.

Age Requirements

The Services are not intended for children under 13 years of age. By using the Services, you represent that you are at least 13 years old, or that you have obtained parental consent if you are between 13 and 18 years old.

Governing Law; Disputes

These Terms of Use are governed by the laws of the State of New Jersey. Any disputes arising from these Terms shall be resolved through binding arbitration administered by JAMS, unless you opt out within 30 days of first using the Services by emailing support@agentic-engineer.com with the subject line "ARBITRATION OPT-OUT."

Changes to Terms

We may update these Terms of Use at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms of Use is found unenforceable, the remaining provisions shall remain in full force and effect.
